CLARIFICATION TEXT AND LEGAL NOTICES ON THE PROTECTION OF PERSONAL DATA
ECHOMAR Clarification Text on the Protection of Personal Data
1- Identity of the Data Controller
As the data controller, Tüm-med Sağlık Kontrol Merkezi A.Ş. (“Echomar”), located at 19 Mayıs Cad. Nova Baran Plaza No:4 K:5 Şişli-İstanbul, shows great sensitivity in processing and preserving all kinds of personal data belonging to you in the best possible way and with due diligence. In this regard, within the scope of our obligation to inform in order to act in compliance with the Personal Data Protection Law No. 6698 (“Law”) and the relevant legislation, we hereby present the following issues to your attention.
2- Purpose of Processing Personal Data
Your personal data may be collected in accordance with the basic principles stipulated in the Law and for the purposes of personal data processing set out in Articles 5 and 6 of the Law, depending on the nature of the service, for the reasons stipulated in the Law and for the performance of the contractual relationship, within the framework of carrying out our activities, operating and developing our services.
In order to provide you with high standards of service, your personal data processed by Echomar may be obtained verbally, in writing, visually or electronically depending on the nature of the health services provided, through automatic or non-automatic methods, via Call Center, internet, online services, mobile applications, physical venues, counters and similar channels.
Including but not limited to your health data, the special categories of personal data and general personal data processed by Echomar; your name, surname, Turkish ID number, if you are not a Turkish citizen, your passport number or temporary or foreign ID number, your place and date of birth, marital status, gender, Echomar-specific protocol number and other identification data that may identify you; your address, phone number, e-mail address and other contact information; your financial data such as bank account number, IBAN number, payment and billing information; your laboratory and imaging results, test results, examination data, prescription information you provided for monitoring in your file, health and sexual life-related data obtained during the execution of medical diagnosis, treatment and care services; audio and digital data that may be obtained by electronic or non-electronic methods from time to time; personal health data obtained during the execution of all medical diagnosis, examination, treatment and care services, especially your health data; your private health insurance data and Social Security Institution data for the purpose of financing and planning of health services; your health and identity data submitted through our websites; your responses and comments shared to evaluate our services; images and audio recordings obtained from the closed-circuit camera system during your visit to Echomar and its affiliates; voice call recordings kept when you contact our Call Center; your vehicle license plate and registration data if you use our parking and valet service; browsing information, IP address, browser information and medical documents, surveys, form information and location data you transmit voluntarily during the use of our website and mobile application; personal data you share when participating in trainings, seminars or organizations organized by Echomar; may be processed within the scope of the personal data processing conditions and purposes specified in the applicable Law and other relevant legislation.
Your personal data, including special categories of personal data, may be processed for the purposes of protecting public health, preventive medicine, execution of medical diagnosis, treatment and care services, planning and management of health services and financing; informing you about your appointment if you have made one; planning and managing Echomar’s internal operations, conducting analysis for the purpose of improving health services; training and developing our employees, monitoring and preventing unauthorized transactions; fulfilling risk management and quality improvement activities; conducting research; fulfilling legal and regulatory requirements; billing for our services; verifying your identity; verifying your relationship with institutions contracted with Echomar; sharing requested information with the Ministry of Health and other public institutions and organizations as required by the relevant legislation; sharing requested information with private insurance companies within the scope of financing of health services; responding to any questions and complaints regarding our health services; taking all necessary technical and administrative measures within the scope of data security of Echomar systems and applications; analyzing your use of health services for the purpose of improving and enhancing the health services we provide; storing your health data; keeping information regarding your health data that must be stored in accordance with the relevant legislation; ensuring financial reconciliation related to health services provided to you with our contracted institutions; improving patient satisfaction, including but not limited to the execution and development of medical diagnosis, treatment and care services, planning and management of patients and health services and financing, increasing patient satisfaction, research and similar purposes.
The “Personal and Special Categories of Data” specified above may be processed within the framework of the provisions of the Law and related legislation, the Basic Law on Health Services No. 3359, Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliated Institutions, the Private Hospitals Regulation, the Regulation on Processing and Protection of Privacy of Personal Health Data, Ministry of Health regulations and other legislative provisions, and may be transferred to physical archives and IT systems belonging to Echomar and/or external service providers and preserved in both digital and physical environments.
As for your medical data such as test results, reports, x-rays delivered to Echomar regarding examinations, treatments and similar processes at other health institutions, if you do not collect them upon discharge, they will be destroyed within three months.
3- Transfer of Processed Personal Data
Your collected personal data may be shared or transferred, for the purposes explained in Article 2 of this Clarification Text and to ensure Echomar’s compliance with relevant legislation provisions, to our suppliers, service providers, legally authorized third parties, the Ministry of Health, its affiliated sub-units and family health centers, private insurance companies (health, pension and life insurance, etc.), Social Security Institution, General Directorate of Security and other law enforcement agencies, General Directorate of Population and Citizenship Affairs, Turkish Pharmacists Association, courts, medical centers and third parties providing health services, health institutions you are referred to or apply to yourself, your authorized representatives, the institution you are affiliated with and/or working for, third-party consultants (lawyers, tax advisors, auditors, etc.), regulatory and supervisory authorities and official authorities, laboratories, systems and business partners with which we cooperate in Turkey or abroad for medical diagnosis (you may apply to Echomar in writing for more detailed information), within the framework of Articles 8 and 9 of the Law and limited to the purposes specified in this Clarification Text.
4- Method and Legal Grounds of Collecting Personal Data
Your personal data may be collected by Echomar through automatic or non-automatic means, based on legal grounds due to the performance of contractual relationships or our legitimate interests, and based on your explicit consent as the legal ground in case you accept the use of optional cookies in order to carry out personalized promotion activities. Your personal data is collected by Echomar electronically, through our website; on legal grounds related to the purposes specified in Article 2 of this Clarification Text, which are the purposes you disclose your personal data to us.
However, as explicitly stated in Article 6, paragraph 3 of the Law, personal data relating to health and sexual life may be processed without the explicit consent of the data subject by persons or authorized institutions and organizations who are under the obligation of confidentiality, for the purposes of protecting public health, preventive medicine, execution of medical diagnosis, treatment and care services, and planning and management of health services and financing.
5- Rights of the Personal Data Subject
Pursuant to Article 11 of the Law, the person whose personal data is processed may apply to Echomar and make requests regarding the following:
- To learn whether their personal data is being processed;
- If their personal data has been processed, to request information about it;
- To access their personal health data and request these data;
- To learn the purpose of processing personal data and whether they are used in accordance with the intended purpose,
- To know the third parties in the country or abroad to whom personal data is transferred;
- To request the correction of personal data if it is incomplete or incorrectly processed;
- To request the deletion, destruction or anonymization of personal data if the reasons requiring its processing cease to exist;
- To request notification of such correction, deletion, destruction or anonymization to third parties to whom the data has been transferred;
- To object to the emergence of a result against themselves by means of analysis of the processed data exclusively through automated systems;
- To request compensation in case of damages due to unlawful processing of personal data.
6- Data Security and Right to Apply
In order to exercise the above-mentioned rights, you may submit your request including necessary information to identify yourself and explanations regarding the right you wish to exercise among those specified in Article 11 of the Law, by filling out the “Application Form Pursuant to the Personal Data Protection Law” available at https://echomar.com/KVKK/kvkk-basvuru-formu-echomar.pdf; by delivering a signed copy of the form in person to the address 19 MAYIS CAD. NOVA BARAN PLAZA NO:4 K:5 ŞİŞLİ-İSTANBUL, or by sending it via Notary, or by transmitting it to Echomar’s registered e-mail address info@echomar.com.tr using secure electronic signature, mobile signature, or the e-mail address previously notified to the data controller and registered in the data controller’s system.

Depending on the nature of your request, your applications will be finalized free of charge as soon as possible and within no later than thirty days; however, if the transaction requires an additional cost, you may be charged a fee according to the tariff determined by the Personal Data Protection Board.
Commercial Communication and Commercial Electronic Message Clarification Text
By filling out any communication and information forms available on the Echomar website (echomar.com) and sending them to Echomar, the personal data and contact information sent; by approving the relevant fields, you give permission under the Law on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, for the storage and processing of your personal data, including those relating to your health status, within the scope of the planning and execution of marketing processes by TÜMMED SAĞLIK KONTROL MER. A.Ş., for the customization of Echomar’s products and services according to the needs and habits of the data subject and the creation of campaigns and opportunities, and for their transfer to group companies, suppliers with which Echomar cooperates or will cooperate, and for the sending of test and examination results, surveys, advertisements, promotions, campaigns and similar commercial electronic messages to the contact information specified within this scope, by sending the communication form and approving the relevant fields.
