ECHOMAR Information Text Regarding the Protection of Personal Data

1- Identity of the Data Controller

As the data controller, Tüm-med Health Control Center Inc. (“Echomar”), operating at 19 Mayıs Cad. Nova Baran Plaza No:4 K:5 Şişli-Istanbul, shows the utmost sensitivity in processing and preserving all kinds of personal data belonging to you in the best and most careful manner possible. Accordingly, in order to act in compliance with the Law on the Protection of Personal Data No. 6698 (“Law”) and related regulations, we present the following matters to your information within the scope of our obligation to inform.

2- Purpose of Processing Personal Data

Your personal data may be collected within the framework of the execution, operation, and improvement of our services in accordance with the basic principles stipulated in the Law and the purposes of personal data processing specified in Articles 5 and 6 of the Law, depending on the nature of the service, and due to reasons stipulated in the Law and performance of contractual obligations.

In order to provide you with high standards of service, your personal data processed by Echomar may be collected verbally, in writing, visually, or electronically, depending on the nature of the health services provided, through automatic or non-automatic methods such as Call Center, internet, online services, mobile applications, physical premises, and counters.

Including but not limited to your health data, the special categories of personal data and general personal data to be processed by Echomar are: your name, surname, T.C. Identity number, passport number or temporary/foreign T.C. Identity number if you are not a Turkish citizen, place and date of birth, marital status, gender, Echomar-specific protocol number and other identification data that can define you; your address, phone number, e-mail address and other contact data; your financial data such as bank account number, IBAN number, payment and billing information; your laboratory and imaging results, test results, examination data, prescription information provided for tracking in your file, and your health and sexual life data obtained during the execution of medical diagnosis, treatment and care services; voice and digital information that may be obtained electronically or non-electronically at various times; primarily your personal health data obtained during the execution of all medical diagnosis, examination, treatment and care services; your data regarding private health insurance and Social Security Institution for the financing and planning of health services; your health and identification data sent via our websites; your responses and comments shared for the evaluation of our services; your image and audio recordings taken by closed-circuit camera systems during your visit to Echomar and its affiliates; voice call recordings if you contact our Call Center; your vehicle license plate and registration data if you benefit from parking and valet services; browsing information obtained during the use of our website and mobile application, IP address, browser information and medical documents, surveys, form information, and location data you voluntarily transmit; your personal data shared when you participate in training, seminars, or organizations organized by Echomar; are processed within the framework of personal data processing conditions and purposes specified in the Law and other related legislation.

Including special categories of personal data, your personal data may be processed for the purposes of protecting public health, preventive medicine, medical diagnosis, execution of treatment and care services, planning and management of health services and financing; informing you about your appointment in case of an appointment; planning and managing Echomar’s internal operations, conducting analysis to improve health services; training and developing our employees, monitoring and preventing unauthorized operations; fulfilling risk management and quality improvement activities; conducting research; fulfilling legal and regulatory requirements; issuing invoices in return for our services; verifying your identity; verifying your relationship with institutions that have an agreement with Echomar; sharing requested information with the Ministry of Health and other public institutions and organizations pursuant to the relevant legislation; sharing requested information with private insurance companies within the scope of health services financing; responding to all your questions and complaints regarding our health services; taking all necessary technical and administrative measures within the scope of data security of Echomar systems and applications; analyzing your use of health services for the purpose of improving and enhancing the health services we provide and storing your health data; preserving the information regarding your health data that must be stored as required by the relevant legislation; ensuring financial reconciliation regarding health services provided with our contracted institutions; improving patient satisfaction, conducting research, and for similar purposes, including but not limited to the execution, improvement, planning, and management of medical diagnosis, treatment, care, and financing of health services.

The above-mentioned “Personal and Special Categories of Data” may be processed within the framework of the Law and relevant legislation provisions, Law No. 3359 on the Basic Law on Health Services, Decree-Law No. 663 on the Organization and Duties of the Ministry of Health and Its Affiliated Institutions, Regulation on Private Hospitals, Regulation on Processing and Protection of Privacy of Personal Health Data, and regulations of the Ministry of Health and other legislation provisions, and may be transferred to physical archives and information systems belonging to Echomar and/or external service providers and stored in both digital and physical environments.

In relation to processes such as examinations and treatments at other healthcare institutions, your health data such as examination results, reports, and x-rays submitted to Echomar will be destroyed within three months if you do not collect them at discharge.

3- Transfer of Processed Personal Data

Your personal data collected may be shared or transferred to our suppliers, service providers, legally authorized third parties, Ministry of Health, affiliated sub-units and family medicine centers, private insurance companies (health, retirement, life insurance, etc.), Social Security Institution, General Directorate of Security and other law enforcement agencies, General Directorate of Population, Turkish Pharmacists’ Association, courts, medical centers and third parties providing healthcare services, healthcare institutions where you are referred or personally apply, your authorized representatives, the institution you are affiliated with and/or working at, third parties from whom we receive consultancy (lawyers, tax consultants, auditors, etc.), regulatory and supervisory authorities and official authorities, laboratories, systems and business partners with whom we cooperate in Turkey or abroad for medical diagnosis (you can request more detailed information by applying to Echomar in writing), limited to the purposes explained in Article 2 of this Information Text and within the framework of Articles 8 and 9 of the Law and in compliance with the relevant legislation.

4- Method and Legal Reason for Collecting Personal Data

Your personal data may be collected by Echomar through automatic or non-automatic means, due to the performance of the contractual relationship or based on our legitimate interest, and with your explicit consent in cases where optional cookies are used for conducting personalized promotional activities. Your personal data is collected electronically through our website, for the purposes of fulfilling the objectives specified in Article 2 of this Information Text, which you disclose to us.

However, as explicitly stated in Article 6/3 of the Law, personal data regarding health and sexual life may be processed without the explicit consent of the data subject for the purposes of protecting public health, preventive medicine, medical diagnosis, execution of treatment and care services, and management of health services and financing, by persons under the obligation of confidentiality or authorized institutions and organizations.

5- Rights of the Personal Data Owner

Pursuant to Article 11 of the Law, the data subject whose personal data is processed may apply to Echomar and make requests regarding the following:

• Learning whether their personal data is processed,
• Requesting information if personal data has been processed,
• Accessing and requesting their personal health data,
• Learning the purpose of processing personal data and whether they are used in accordance with their purpose,
• Learning the third parties to whom personal data is transferred domestically or abroad,
• Requesting correction if personal data is incomplete or incorrectly processed,
• Requesting deletion, destruction, or anonymization of personal data in case the reasons requiring their processing are eliminated,
• Requesting notification of these corrections or deletions to third parties to whom data has been transferred,
• Objecting to the emergence of a result against the person by analyzing the processed data exclusively through automated systems,
• Requesting compensation in case of damage due to unlawful processing of personal data.

6- Data Security and Right to Apply

Depending on the nature of your request, your applications will be concluded free of charge as soon as possible and within thirty days at the latest; however, if the process requires an additional cost, a fee may be charged from you according to the tariff determined by the Personal Data Protection Board.

By filling out any communication and information form on Echomar’s website (echomar.com) and sending your personal data and contact information to Echomar; by approving the relevant fields, you consent within the scope of the Law on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, to the storage, processing, and transfer of your personal data, including those related to your health condition, for the planning and execution of marketing processes by TÜMMED HEALTH CONTROL CENTER INC., for the customization of Echomar’s products and services according to the needs and habits of the data subject, for the creation of campaigns and opportunities, and to receive test and examination result information, surveys, advertisements, promotions, campaigns, and similar commercial electronic messages sent to the specified contact information.
